As I write this, Judge Vaughn Walker is holding a pre-trial hearing in the case brought by legal superstars Ted Olson and David Boies in their case against California's Prop. 8. Karen Ocamb has an extensive pre-hearing report:
Today may mark the beginning of the end of the ugly Prop 8 as attorneys Ted Olson and David Boies lay out their federal case for why the California constitutional amendment is unconstitutional.Karen has a rundown on the legal issues at play -- and we'll post any news or updates that arise from the hearing later today. Be great if the trial was televised, although the Judicial Conference of the United States forbids televising trials. It's an on-going debate and federal legislation to allow televising trials has gone no where.
The pre-trial evidentiary hearing starts at 10:00am in the San Francisco courtroom of District Court Judge Judge Vaughn R. Walker. Olson and Boies will argue that the case should go to trial. Walker has already set a trial date of Jan. 11 and some reporters and bloggers, such as Patrick Range McDonald at the LA Weekly, want the trial to be televised. Walker will consider that issue today, as well as others such as scheduling motions on evidence and witnesses.
